1. Who can I sponsor under Canada’s Spousal or Common-Law program?
You can sponsor your legally married spouse, common-law partner (lived together for at least 12 months), or conjugal partner (if living together was impossible for reasons beyond your control).
 

2. What’s the difference between Inland and Overseas (Family Class) Sponsorship?

  • Inland: Your partner is already in Canada. They can apply for a Spousal Open Work Permit while the PR application is processed.

  • Overseas: Your partner is outside Canada. They apply for a Spousal Open Work Permit when they are physically in Canada. 
     

3. How long does the process take?
Typical processing time is 12–18 months, depending on case type and visa office workload. Inland applications may get work permit approval within 4–6 months.
 

4. Can my spouse work while the application is being processed?
Yes — if you apply Inland and include the Spousal Open Work Permit (SOWP). It lets your partner work anywhere in Canada while waiting for PR.


5. Do we need to be legally married to apply?
No. Common-law partners (12 months of continuous cohabitation) and conjugal partners (relationship of at least one year but living together is impossible due to legal or immigration barriers) also qualify.


6. How do we prove our relationship is genuine?
Provide joint documents such as leases, bank accounts, photos, messages, travel records, and letters of support from friends and family. IRCC looks for consistency and credibility.


7. Can I sponsor my partner if I am not working?
Yes — you don’t need a minimum income for spousal sponsorship (unless you have dependent children with their own dependents). However, you must prove you can support your partner financially without social assistance.


8. Can we include a visitor visa or extend a stay while waiting for sponsorship?
Yes. Many couples apply Inland after entering Canada on a valid visitor or study/work permit.
If your partner’s status is expiring, you can often apply to extend it together with your Inland sponsorship package. Maintaining valid status in Canada is important while waiting for approval.
 

9. Can my partner include their children in the application?
Yes — dependent children under 22 who are unmarried can be included and will also receive PR status if approved.


10. What happens after approval?
If Inland, your partner becomes a Permanent Resident in Canada and receives their PR card by mail. If Overseas, they receive a Confirmation of Permanent Residence (COPR) and travel to Canada to land.
